Felona e Sorona is an album by the Italian progressive rock band Le Orme. It was released in 1973.

Usually ranked amongst the finest albums of 1970s progressive rock, it is a concept album pivoting on the story of two planets which revolve one around the other, without ever coming in contact. While Felona is shiny and flourishing, Sorona is dark and home to plagues and catastrophes: however, in the second part of the suite, the fate of the two planets is inverted.

Apart from two acoustic interludes, the music is mainly keyboard- and synth-driven, producing gloomy and spacey effects, especially in the opening “Sospesi nell’incredibile” and in the famous instrumental ending piece, “Ritorno al nulla” (“Return to Naught”).

    Oh Troy, I intend to. And if it can’t be stopped, I will sue the company in small claims court when the well goes dry. According to NC law a property owner has to be within 1000 feet of the excavation before they are notified and we weren’t because my Mom’s property is 1200 – Wow – a whole 200 feet. Somebody tell that to the water that it can’t drain past 1000 feet.

    I have an idea for the next (hopefully soon) even bigger march on Washington DC….Maybe we can make it go viral or someone can propose it to a Tea Party organizer/group….Here it is: Mandatory, every single protester carry, along with their choice of poster/placard or simply solo, a cardboard or styrofoam pitchfork….I think it will speak for itself.

    i know this is off topic, but i started thinking about
    alligators and crocodiles. read about people/animals getting
    attacked, but i thought that the alligator habitat was only Florida.
    looked it up on google and saw that gator habitat extends from Brownsville, up to Dallas, Arkansas and all the way around the Gulf, up Florida to NC at the Virginia border. boundary seems to go pretty deep into the Gulf and Atlantic states.

    SEATTLE — A Web site says a Somali-American from Seattle was one of the suicide bombers who killed 21 peacekeepers in Somalia last week, CNN reported.
    CNN quotes an online Somali-language Web site as saying the bomber lived in Seattle until 2007.

    The report could not be independently confirmed.

    An FBI spokesman in Seattle, Fred Gutt, told CNN that investigators are aware of the report, but he declined to comment about it in detail. When asked if the FBI was looking into the report, Gutt would only say “we have continuing outreach efforts with the (Somali-American) community.”

    Federal agents have been investigating possible recruiting efforts in the United States by Al-Shabaab, a Somali group with ties to al Qaeda that the U.S. classifies as a terrorist organization.

    More than a dozen young men of Somali descent have disappeared recently from their homes in and around Minneapolis, Minnesota, which has a sizable Somali population, as does Seattle. At least three have ended up dead in Somalia, community leaders say.

    OMG… I read Troy’s post… sitting here feeling sick, making myself sick for what I did today…
    Took my son (8yr) to dr this morning for his horrible caugh.
    Happens this time of year, this his third year we have had him in and they put him on pro-air for asmatic…
    While there we both got the flu shot…
    After reading Tory’s post my heart sunk, what the hell did i do…

    Then I see jr’s post…
    I have no clue if what we got was from single or multi does bottle, the nurse came in with shots ready…

    calming down…. where the hell are those papers I brought home… got to go find them…

    Joldy, I do not have an decided opinion on flu vaccines due to the fact that there is so much info / disinfo out there…Who knows what the hell to believe?….My position is that I have never had a flu shot and I don’t see a reason to start now….If I see a huge swath of the population dying from the flu I might change my mind, but I doubt it….I just post new stuff that I find…It’s up to everyone to make up their own minds.

    Drug companies are keen to improve ‘compliance’ rates among patients as most end up not taking their correct dosages because of unpleasant side effects or a failure to gain symptoms quickly.

    WASHINGTON — The FBI is investigating the hanging death of a U.S. Census worker near a Kentucky cemetery, and a law enforcement official told The Associated Press the word ‘fed” was scrawled on the dead man’s chest.

    The body of Bill Sparkman, a 51-year-old part-time Census field worker and occasional teacher, was found Sept. 12 in a remote patch of the Daniel Boone National Forest in rural southeast Kentucky. The Census has suspended door-to-door interviews in rural Clay County, where the body was found, pending the outcome of the investigation.

    Investigators are still trying to determine whether the death was a killing or a suicide, and if a killing, whether the motive was related to his government job or to anti-government sentiment.

    Investigators have said little about the case. The law enforcement official, who was not authorized to discuss the case and requested anonymity, said Wednesday the man was found hanging from a tree and the word “fed” was written on the dead man’s chest. The official did not say what type of instrument was used to write the word.

    FBI spokesman David Beyer said the bureau is helping state police with the case.

    “Our job is to determine if there was foul play involved — and that’s part of the investigation — and if there was foul play involved, whether that is related to his employment as a census worker,” said Beyer.

    Beyer declined to confirm or discuss any details about the crime scene.

    Lucindia Scurry-Johnson, assistant director of the Census Bureau’s southern office in Charlotte, N.C., said law enforcement officers have told the agency the matter is “an apparent homicide” but nothing else.

    Census employees were told Sparkman’s truck was found nearby, and a computer he was using for work was found inside it, she said. He worked part-time for the Census, usually conducting interviews once or twice a month.

    Sparkman has worked for the Census since 2003, spanning five counties in the surrounding area. Much of his recent work had been in Clay County, officials said.

    Door-to-door operations have been suspended in Clay County pending a resolution of the investigation, Scurry-Johnson said.

    The U.S. Census Bureau is overseen by the Commerce Department.

    “We are deeply saddened by the loss of our co-worker,” Commerce Secretary Gary Locke said in a statement. “Our thoughts and prayers are with William Sparkman’s son, other family and friends.”

    Locke called him “a shining example of the hardworking men and women employed by the Census Bureau.”

    This has been bothering me ever since she went on the record with that blatant misrepresentation….She should be forced, in a court of law, to provide the law that enabled her to make such a bold statement.

    Is it, at this point, necessary to challenge Obama’s eligibility or would a challenge to the official use of the phrase “natural born citizen”, in order to sanitize Obama’s status, be enough to open the flood gates.

    Dr. Fukno unintentionally (or maybe it was intentional, who knows?), through the Hawaiian Attorney General, used language in her public press release that Obama was a natural born citizen….She can’t do that without opening the door to legal challenges to that language….It is the perfect opportunity for a good lawyer to press this all the way to the U.S. Supreme Court since they are the only ones that have the legal authority to define the meaning of the term, NBC….It is an excellent opportunity to force the SCOTUS, once and for all, to constitutionally define NBC.

    After Dr. Fukino put out that press release I emailed a letter to Hawaii Governor Linda Lingle….In the letter I demanded that she order a public retraction of Fukino’s press release or at least publicly amend it to exclude the language, “natural-born American citizen”…..In the letter I gauranteed her that, if a retraction wasn’t made, there would be legal challenges to that language that could eventually derail Obama’s presidency….I, in as nice of a way as I could, warned her that if a retraction wasn’t made that it would come back to haunt those involved.

    Some of you may remember me saying that I had sent a letter to the Governor and that I hoped some black sedans didn’t show up in my driveway.

    It has been eating on me ever since Fukino made that statement that no legal challenge was filed against Dr. Fukino and the Hawaii Dept. of Health….Leo isn’t exactly challenging the use of the term “natural born citizen”, but is instead going after the Hawaiian documents that were used to make that determination…..If played correctly, I think there may be an opening for a challenge to the actual language, NBC…Finally, I think that he may just be on the right path…I sure hope so.

    Considering that Afghanistan was the breeding ground for the 9/11 attacks, we cannot allow that to happen,” said American Legion National Commander Clarence E. Hill.

    “We have seen a successful troop surge and counterinsurgency strategy work in Iraq.

    We owe it to our men and women who are serving in Afghanistan to do the same there.

    We must give them the tools they need to succeed.”

    Hill said he is troubled that civilian officials in Washington appear reluctant to grant McChrystal’s request, which many believe could be as high as 40,000 additional troops.

    Pentagon Press Secretary Geoff Morrell said Defense Secretary Robert Gates will not consider escalating the military mission in Afghanistan until President Obama and his national security team “are ready to consider it.”

    “More than 800 brave American heroes have died in Afghanistan so far,” Hill said.

    “They died replacing and then protecting us from an evil regime that harbored terrorists.

    We must not try to ‘fight a war on the cheap’ and let our losses be for naught.

    General David Petraeus and Admiral Mike Mullen both support General McChrystal’s report.”

    Hill’s position is also shared by former U.S. Secretary of State Condoleezza Rice who said in Fortune Magazine,

    I completely agree with Art that the Smoot-Hawley tariff was the major cause of the Great Depression.

    So it is certainly disturbing to see the Obama Administration pander to the United Steelworkers by slapping a tariff on tires imported from China.

    This morning’s WSJ reports that three paper companies and the United Steelworkers filed an antidumping case Wednesday against China and Indonesia, making good on the union’s threat to protect other US industries after winning a recent trade decision against China.

    We’ve seen plenty of similar trade flare-ups in the past even during the Reagan and Bush Administrations.

    Nevertheless, they can spin out of control.

    More importantly, now is not a good time to resort to protectionism given that the global economic freefall earlier this year was mostly attributable to a collapse in exports as trade credits froze up.

    A bigger and more likely threat to a sustainable recovery is the sun-setting of the Bush tax cuts after 2010.

    This will amount to a major tax increase that could send the economy back into a recession in 2011.

    I don’t think this will trip up the bull market any time soon.

    But it is likely to become a big issue by the second half of next year.

    Sure Troy. I hear from Steven almost daily. We can expect that the conference outcome may not be known for a bit, so we’ll have the usual period of mystery to endure.

    I’m also excited that Fukino/Okubo may have stepped in it. I was also very taken by the NBC declaration and wondered if that could be challenged. Leo is the guy for this, he’s very tenacious (sorry Tenacity).

    Craig’s case could go a long way on putting this issue in the forefront. Of course, the probabilities based on the past on not optimistic. We’ll just have to stay tuned and give it time.

    The idea of a SuperFed is also likely to meet stiff congressional opposition given the Fed’s role in creating the financial bubble through errors in monetary policy and lapses in regulatory judgment.

    Creation of a SuperFed might also have to accompany passage of a bill to audit the central bank, another threat to its independence.

    Christopher Dodd, Frank’s opposite in the U.S. Senate, favors a single regulator to oversee banks.

    Ideally, the Fed would then be free to focus on its core mission of conducting monetary policy, while,

    as an American Enterprise Institute analysis put it,

    a separate super-regulator could enjoy supervisory economies of scale and achieve consistency.

    I have some close friends that have worked for the post office their entire adult lives….They wonder how long they will have jobs….One big proposal is that the PO close on Saturdays….The savings from that one day off would be astronomical….It seems like a no brainer to me…I don’t think that one day of being closed will make a noticable impact in their service….I would never say this to them personally, but they have told me of what all they are entitled to through their postal union, besides a very high wage for doing a job that they admit a chimp could do, and it is no wonder that they are going out of business….The union is putting the post office out of business just like it did to General Motors.

    Folks, I just got this from Steven Craig regarding his case:

    Well, the earliest the results of the conference will be posted is probably Oct 5th. From looking at the size of the conference list for the full Sept 29th list, it is very difficult to predict when anything on my case will be posted.

    With the 10th Circuit having spoken I have the possibility of returning to the USDC on Remand with an Amended Complaint of Companion Case. The difficulties of Jurisdiction and Standing remain in that venue even though it is my opinion that errors were made by both courts and as indicated in their footnotes, ‘RES JUDICATA’ does not apply to their orders and judgements.

    There is the possibility that SCOTUS will remark ‘per incuriam’ or otherwise. Perhaps even refute the 10th when it says no citizen has a ‘Right’ to be determined NBC.

    In other words, it’s hard to say when or what I’ll do next until I see the words from SCOTUS.

    No answer is an answer just as a partial or full answer will be answers. Regardless, I will not be returned to square one.

As yet, no one has found a SCOTUS ruling that actually defines the term. There is considerable research regarding founding father intent that goes back to Emmerich Vattel in the Laws of Nations. It favors the definition being ‘born of citizen parents’ (plural).

    I disagree Grammy….The very reason that they haven’t resolved it is because of the oaths….You see, they are between a rock and a hard place….They know full well that he isn’t eligible, but if they rule that way then they realize that the country will go up in flames from the Obots burning down entire cities.

    Thank you for contacting me in opposition to H.R. 3200, the America’s Affordable Health Choices Act. I appreciate hearing from you on this important matter, as well as your patience in awaiting my reply.

    While I am sensitive to your concerns, I support H.R. 3200, which will reduce health care costs, protect and increase consumers’ choices, and guarantee access to quality, affordable health care for all Americans. Few challenges we face are as complex and consequential as fixing our health system. Unsustainable health care costs represent the single largest threat to our long-term prosperity, draining our federal budget and jeopardizing the financial security of families across the country. Without question, we cannot get our economy back on track without repairing the American health care system. The most disastrous health plan is a simple extension of the status quo.

    Our current health care system will cost the US economy as much as $248 billion in lost productivity this year alone. With employers unable to afford rising health care costs, our country could see an additional 3.5 million people unemployed and without benefits in the next four years. In fact, according to a recent report issued by the Business Roundtable, an association of CEOs of leading US companies, without significant reform employer health care costs will jump 166 percent over the next decade, from $10,743 per employee today to $28,530 by 2019. By then, total health care spending would reach $4.4 trillion, “consuming more than 20 percent of the U.S. Gross Domestic Product.” The report concludes that “maintaining the status quo is simply not an option. These costs are unsustainable and would put millions of workers at risk.”

    At least 46 million Americans are currently uninsured – more than 85 percent of whom are working families. Without wellness and preventive care, families suffer, and their care drives up costs throughout the system. American families end up paying $100 billion a year providing coverage for the uninsured, an average of $1,100 in additional premium costs per insured family every year.

    Since 2000, premiums have more than doubled while wages have virtually stood still. The average health care premium for a family was $12,812 in 2007, and without reform, costs for the average family are expected to increase by $1,800 every year. With 9.0 percent unemployment in New York, many more families are at risk of losing their health coverage.

    Moreover, more than 3 million non-elderly people spent ten percent or more of their pre-tax family income on health care costs in 2008. New York’s senior population is not exempted from high out of pocket costs for health care either. In fact, people with Medicare coverage spend about 30 percent of their incomes on out of pocket health costs.

    Reforming our health care system is not a new idea, nor is it being rushed through the legislative process without careful consideration. America has debated how to fix what is broken in our health care system for more than six decades, yet we have never been closer to achieving real reform than we are now. In just over two years, the House has held 79 Congressional hearings on health insurance reform and Members of Congress have held more than 550 health care town halls and public events all across the country. Three separate House committees have already had more than 45 hours of debate and amendments on this legislation.

    We need a uniquely American solution to build on what works and fix what is broken. Though many of the details are still under debate, the Democratic Congress and President Obama agree on four principles that will form the foundation of the bill Congress sends to the President to be signed into law:

    1. Affordable coverage for every American: Through competition and choice, we will make coverage more affordable for everyone – guaranteeing fairness and competition in the marketplace, simplifying paperwork for patients and doctors, saving lives and money with electronic medical records, and cracking down on waste, fraud and abuse. Focusing on primary care, prevention and wellness is the first step.

    At the center of our cost-lowering plan is a public insurance option that will strengthen competition in the insurance market and pressure private insurers to lower costs. For doctors, the plan includes research on health outcomes to inform treatment choices and electronic records to improve collaboration – both of which can make treatment more cost-effective. In 2008, hospitals and health care providers in our district provided $270 million worth of uncompensated care, care that was provided to individuals who lacked insurance coverage and were unable to pay their bills. Under the H.R. 3200, these costs of uncompensated care would be virtually eliminated.

    For seniors, it means an end to the infamous Medicare Part D “doughnut hole,” which prevents seniors with prescription drug costs of $2,700 to $6,100 per year from receiving Medicare support. Each year, 9,000 seniors in our district hit the donut hole and are forced to pay their full drug costs, despite having Part D drug coverage. The legislation would provide them with immediate relief, cutting brand name drug costs in the donut hole by 50 percent, and ultimately eliminate the donut hole.

    And for small businesses, lower health care costs will remove a crippling burden that stifles their productivity and competitiveness. Under the legislation, as many as 12,700 small businesses in our district could qualify for tax credits of up to 50 percent of the costs of providing health insurance. Small businesses with 25 employees or fewer and average wages of less than $40,000 will be eligible for this credit.

    2. Stability for the middle class: Your health needs will be covered by insurance and your coverage can never be taken away, providing peace-of-mind and an end to fears of lost coverage and financial disaster. It will prevent medical bills from driving Americans into bankruptcy, and it will stop insurance companies from denying patients coverage because of what they consider pre-existing conditions, such as pregnancy, diabetes, heart disease or cancer. It will also mean truly secure coverage that doesn’t end if a worker loses a job, changes jobs or decides to start a new business.

    There were 960 health care-related bankruptcies in our district in 2008, caused primarily by the health care costs not covered by insurance. H.R. 3200 provides health insurance for almost every American and caps annual out-of-pocket costs at $10,000 per year, ensuring that no citizen will have to face financial ruin because of high health care costs. Additionally, under the plan there will be no more lifetime limits on how much insurance companies will pay.

    3. Higher-quality care: Besides putting more health decisions in the hands of doctors and patients, not insurance accountants, one of the biggest things we can do to be a healthier nation is to strengthen our focus on preventive care.

    Americans without insurance regularly forego the care that can keep chronic problems from turning into major illnesses, and even patients with insurance are often discouraged by out-of-pocket costs. Expanding coverage and ending out-of-pocket payments for care such as check-ups, mammograms, and diabetes exams can mean better health and big savings in the long run.

    4. Patient choice: Americans who like their coverage can keep it. In fact, the plan will expand choice by freeing doctors and patients to make the choices that maximize healthy outcomes, not insurance profits. If you like your doctor, keep your doctor. If you like your current plan, keep your current plan. Or you can evaluate the competition and choose a plan that better suits your needs, be it a private plan or the public option.

    I will keep this simple. Here is the text of the suit, which is brought under the MD Wiretap Act. The suit alleges that Andrew Breitbart, working in concert with O’Keefe and Giles, intercepted an “oral communication” using an electronic device, which would indeed be a violation of the act. The problem, however, is that the statute specifically defines “oral communication” in section 10-401(2)(i) as: “any conversation or words spoken to or by any person in private conversation.”

    What this means, as established by the clear text of the statute (and Maryland caselaw, including Fearnow v. Chesapeake & Potomac Tel. Co. of Maryland, 342 Md. 363 (Md. 1996)) is that at least one of the parties to the conversation must have had a reasonable expectation of privacy in the conversation. In other words, if someone stands up in the town square and shouts out loud and someone else records it, that is not a violation of the act.

    The problem for ACORN is that, as a matter of law, the employees at ACORN had no reasonable expectation of privacy in what they said to members of the public who entered their offices. As made clear by Katz v. United States and its progeny (made applicable specifically to the Maryland Wiretap Act by cases such as Malpas v. State, 695 A.2d 588, 595 (Md. Ct. Spec. App. 1997)), “What a person exposes knowingly to the public, even in his own home or office, is not a subject of Fourth Amendment protection.”

    Get that? The conversations in question were knowingly exposed in a place of business to two customers who walked in off the streets. There is and can be absolutely no expectation of privacy for the ACORN employees in question. As such, the conversations are not “private conversations” under the Maryland Wiretap Act as a matter of law. I found all this in a matter of 15 minutes on Lexis. I’m sure another 15 (which I don’t have) will find numerous directly applicable precedents under Katz that are completely factually indistinguishable from the present case. In other words, this case is so totally without legal merit the very filing of it is almost sanctionable. And putting “they had a reasonable expectation of privacy” in the complaint is not enough for this claim to survive summary dismissal; the court does not have to accept conclusory statements and legal conclusions.

    Furthermore, to the extent that ACORN wants to go after Breitbart (and I hear they are wanting to go after Fox next!) for publishing this information of clear public concern, they might want to check the First Amendment jurisprudence of the United States Supreme Court on that question before getting themselves in further trouble.

As part of the program, we had scheduled Sgt. 1st Class Greg Stube, a highly decorated U.S. Army Green Beret and inspirational speaker who was severely injured while deployed overseas and didn’t have much of a chance for survival. Greg is stationed at Ft. Bragg and received permission from his commanding officer to come speak at our function. Everything was on go until Obama made a policy that NO U.S. SERVICEMEN CAN SPEAK AT ANY FAITH-BASED PUBLIC EVENTS ANYMORE. Needless to say, Greg had to cancel his speaking event with us. Didn’t know if anyone else was aware of this new policy. Wonder what kind of news we all will receive next?

    Yesterday judge Carter has issued a chambers order, where he stated that there will not be enough time to review the second amended complaint before the October 5th hearing. My understanding is that judge Carter is ready to rule based on the motion by the defendants and the response and numerous documents and exhibits provided with the response. My feeling is that he will come back with the Solomon’s decision, where he might dismiss one or more less crucial defendants, but will deny motion to dismiss against more important defendants. In this case the judge has room to maneuver and satisfy both sides with his decision. We all will be wiser in 11 days.

    NEW ORLEANS – Bullet-makers are working around the clock, seven days a week, and still can’t keep up with the nation’s demand for ammunition.

    Shooting ranges, gun dealers and bullet manufacturers say they have never seen such shortages. Bullets, especially for handguns, have been scarce for months because gun enthusiasts are stocking up on ammo, in part because they fear President Barack Obama and the Democratic-controlled Congress will pass antigun legislation — even though nothing specific has been proposed and the president last month signed a law allowing people to carry loaded guns in national parks.

    Gun sales spiked when it became clear Obama would be elected a year ago and purchases continued to rise in his first few months of office. The FBI’s National Instant Criminal Background Check System reported that 6.1 million background checks for gun sales were issued from January to May, an increase of 25.6 percent from the same period the year before.

    “That is going to cause an upswing in ammunition sales,” said Larry Keane, senior vice president of the National Shooting Sports Foundation, a trade association representing about 5,000 members. “Without bullets a gun is just a paper weight.”

    The shortage for sportsmen is different than the scarcity of ammo for some police forces earlier this year, a dearth fueled by an increase in ammo use by the military in Iraq and Afghanistan.

    “We are working overtime and still can’t keep up with the demand,” said Al Russo, spokesman for North Carolina-based Remington Arms Company, which makes bullets for rifles, handguns and shotguns. “We’ve had to add a fourth shift and go 24-7. It’s a phenomenon that I have not seen before in my 30 years in the business.”

    Americans usually buy about 7 billion rounds of ammunition a year, according to the National Rifle Association. In the past year, that figure has jumped to about 9 billion rounds, said NRA spokeswoman Vickie Cieplak.

    Jason Gregory, who manages Gretna Gun Works just outside of New Orleans, has been building his personal supply of ammunition for months. His goal is to have at least 1,000 rounds for each of his 25 weapons.

    “I call it the Obama effect,” said Gregory, 37, of Terrytown, La. “It always happens when the Democrats get in office. It happened with Clinton and Obama is even stronger for gun control. Ammunition will be the first step, so I’m stocking up while I can.”

    So far, the new administration nor Congress has not been markedly antigun. Obama has said he respects Second Amendment rights, but favors “common sense” on gun laws. Still, worries about what could happen persist.

    (Sept. 23, 2009) — Commander Charles F. Kerchner, Jr., U.S. Navy Reserve, Retired, is still waiting for justice. But it increasingly appears to be justice delayed for justice denied. Attorney Mario Apuzzo filed Charles F. Kerchner et al. vs. Barack Hussein Obama et al. in January, and it has winded its way through U.S. Federal court, District of New Jersy since Jan. 20th, 2009 when the lawsuit was filed — that is, slowly, very slowly.

    Curently the Plaintiffs are awaiting Judge Jerome B. Simandle’s ruling on two motions: Apuzzo’s brief in Opposition to the Defense’s Motion to Dismiss, and the Cross-Motion he filed on their behalf; the former due from the court on Aug. 3, the latter on Aug. 17. This delay prompts speculation that the Judge is insensitive to the urgency this case requires, since it touches upon the grave crime of usurpation of the office of the Presidency and thus, of the Comander-in-Chief of all American military forces.

    This evening, the lead plaintiff issued a press release:

    The federal court itself set a return/decision date of 3 Aug 2009! It is now 23 Sep 2009! The decision is now over 7 weeks late. This is an outrage!

    The federal courts should not hide and stall on a case of this importance to our nation, i.e., a Usurper in the White House and Congress’s not doing a thing about investigating the charges of the People about it. It is a case in the confines of the Constitution, the contract by which We the People agreed to be governed, specifically in Article II as to who can be the President and Commander-in-Chief of our military. It is this fundamental law of our land. We are a nation of laws not men. Or at least we are supposed to be. Obama and Chicago mafia cronies and the Progressive Caucus in Congress are doing their best to change that.

    Kerchner explains the legal basis for his consternation that Judge Simandle is stalling, by quoting U.S. Supreme Court Chief Justice Marshall, in Cohens v. Virginia 19 US 264 (1821):

    It is most true that this Court will not take jurisdiction if it should not: but it is equally true, that it must take jurisdiction if it should. The judiciary cannot, as the legislature may, avoid a measure because it approaches the confines of the constitution. We cannot pass it by because it is doubtful. With whatever doubts, with whatever difficulties, a case may be attended, we must decide it, if it be brought before us.

    We have no more right to decline the exercise of jurisdiction which is given, than to usurp that which is not given. The one or the other would be treason to the constitution. Questions may occur which we would gladly avoid; but we cannot avoid them. All we can do is, to exercise our best judgment, and conscientiously to perform our duty. In doing this, on the present occasion, we find this tribunal invested with appellate jurisdiction in all cases arising under the constitution and laws of the United States. We find no exception to this grant, and we cannot insert one.

    In consideration of which Commander Kerchner concludes by saying:

    The Judge needs to do his duty. Decide the motions. Grant standing. And hear the case on its merits. What are the courts afraid of … the real facts and the truth. A simple trial in our courts are supposed to find the facts and determine the truth of the charges and resolve this. All we ask is a trial on the merits. Justice Delayed is Justice Denied!

    Attorney Mario Apuzzo publishes an informative blog about this case; and Kerchner is well known for his public advocacy of the underlying legal issues of Obama’s usurpation of the U.S. Presidency.

    WASHINGTON (JTA) — The White House says an official “misspoke” when he said the Obama administration would not allow the Goldstone report recommendations on Israel’s conduct in the Gaza war to reach the International Criminal Court.

    A top White House official told Jewish organizational leaders in an off-the-record phone call Wednesday that the U.S. strategy was to “quickly” bring the report — commissioned by the U.N. Human Rights Council and carried out by former South African Judge Richard Goldstone — to its “natural conclusion” within the Human Rights Council and not to allow it to go further, Jewish participants in the call told JTA.

    Tommy Vietor, a White House spokesman, called JTA later to say the official “misspoke” and that administration policy on the Goldstone report remains as articulated last week by Susan Rice, the U.N. ambassador.

    Rice described the UNHRC mandate as “unbalanced, one sided and basically unacceptable. We have very serious concerns about many of the recommendations in the report. We will expect and believe that the appropriate venue for this report to be considered is the Human Rights Council and that is our strong view.”

    She did not mention what the United States would do were the report to be referred to the U.N. Security Council — a necessary step were the matter to be referred to the International Criminal Court.

    The report said the U.N. fact-finding mission investigating Israel’s conduct during the January 2009 war found evidence of Israeli war crimes. Israel has denied the allegations and said the report’s mandate was biased — an opinion echoed by U.S. officials.

    The Obama administration is ready to use the U.S. veto at the U.N. Security Council to deal with any other “difficulties” arising out of the report, the White House official said Wednesday. The administration also has made clear to the Palestinian Authority that Washington is not pleased with a P.A. petition to bring the report’s allegations against Israel to the International Criminal Court.

    The official said the Obama administration’s view was that the report was flawed from its conception because the mandate presumed a priori that Israel had violated war crimes and that the mandate ignored Hamas’ role in prompting the war through its rocket fire into Israel.

Unfortunately for those few of us who are conservatives in NY, the Dems rule. That’s one of the big reasons I am and always have been an independent. I’m hoping some of the incumbant Dems will be voted out next year but not really expecting it. NY is the most politically disfunctional state in the union imo. Funny personal story is that the local head of the Dem. party is one of my husband’s and my best friends from high school. Great guy but needless to say, we do not see eye to eye re politics.     Pethokoukis: My gosh, I hope this is not one more step toward tax policy harmonization which would likely lead to higher US taxes and the addition of a VAT tax.

    On the other hand, the elevation of the status of the G20 is a good idea, especially if it can eventually have a global security component.

    The Chamber of Commerce has run ads attacking some Democratic health overhaul proposals. But that doesn’t mean the group is lining up squarely behind Republicans.

    “The reality with the business community is that we want reform, while some Republicans want to stop this train and start over,” Bruce Josten, the chamber’s chief lobbyist, told the WSJ. “That is just not going to happen.”

    David Camp, a Republican congressman, argued that the Baucus bill is unlikely to keep its support from the business community. “I wouldn’t confuse pleasant noises about the Baucus bill with an endorsement,” he told the WSJ. “If this bill tacks left, which it is already doing, business won’t support it.”

    (I’d like to ask Mr. Josten why he supports the employer mandate tax in BaucusCare. Is it because he knows it will lead to employers dropping coverage? And this is ultimately what employers want? As I said before, I don’t mind shopping around and purchasing a private plan on my own. But if my employer is not subsidizing me and I don’t qualify for govt subsidies, then how will I be able to afford a plan comparable to the plan I have now?)

    Next week, blasphemy gets its own holiday

    TORONTO—You’ve never seen Jesus like this before: dripping red nail polish around the nails in his feet and hands, an irreverent riff on the crucifixion wounds. The provocative title of the painting: “Jesus Does His Nails.”

    Blasphemous? Absolutely. Deliberately provocative? You bet.

    It is part of an upcoming art exhibit in Washington that will mark the first-ever International Blasphemy Day next Wednesday (Sept. 30) at the Center for Inquiry DC near Capitol Hill.

    Artist Dana Ellyn says her “Blasphemy” paintings are a tongue-in-cheek expression of her lack of belief in God and religion. The self-described “agnostic atheist”—she doesn’t believe in the existence of any deity but can’t say for sure one doesn’t exist—says her introduction to religion was in college when she studied art history. Stories from the Bible, she says, are just that: stories.

    “My point is not to offend, but I realize it can offend, because religion is such a polarizing topic,” Ellyn said of the exhibit.

    Atheists, skeptics, freethinkers and free-speech advocates around the world will mark Blasphemy Day by mounting their soapboxes—figuratively and literally—and uttering words and displaying images that may cause offense.

    And they’re making no apologies.

    “We’re not seeking to offend, but if in the course of dialogue and debate, people become offended, that’s not an issue for us,” said Justin Trottier, a Toronto coordinator of Blasphemy Day and executive director of the Ontario chapter of the Center for Inquiry. “There is no human right not to be offended.”

    St. Thomas Aquinas described blasphemy—deliberately showing contempt or irreverence for something considered sacred—as a sin “committed directly against God … more grave than murder.” In the Gospel of Mark, Jesus said, “Whoever blasphemes against the Holy Spirit can never have forgiveness, but is guilty of an eternal sin.”

    While it may sound as anachronistic as a witchcraft trial, blasphemy remains punishable by death in countries like Pakistan and Afghanistan. In addition, Ireland recently introduced a defamation law making blasphemy punishable by fines up to 25,000 euros ($37,000 US). What’s more, six U.S. states (Massachusetts, Michigan, South Carolina, Oklahoma, Pennsylvania and Wyoming) have laws that, in some way, prohibit or regulate blasphemy, noted Ron Lindsay, a lawyer and president of the CFI International in Amherst, N.Y.

    CFI also cites efforts by the United Nations to introduce anti-blasphemy resolutions that many say would curtail free speech about religion.

    Sept. 30 was chosen for the inaugural Blasphemy Day because it is the anniversary of the 2005 publication of the controversial Muhammad cartoons in the Danish newspaper Jyllands-Posten. The cartoons resulted in worldwide riots by outraged Muslims and widespread self-censorship by media.

    Lindsay said the Blasphemy Day events are part of his group’s larger Campaign for Free Expression, which encompasses more than protection of speech about religion. CFI, he said, aims to expose all religious beliefs to the same level of inquiry, discussion and criticism to which other areas of intellectual interest are subjected.

    Orly Taitz: Big birtherIn a Santa Ana federal courtroom on Sept. 8, Dr. Orly Taitz had a clear message for Judge David O. Carter: Lucas Smith, a witness whom she had brought from the Dominican Republic that morning, had to testify that day—before it was too late.

    “The biggest issue we have today is that evidence is disappearing,” said the Laguna Niguel dentist, lawyer and real-estate agent who is attempting to sue President Barack Obama out of office. “We have a number of parties that had evidence, that had knowledge that might be detrimental to the defense, that were found dead. . . . We have the most important, the most crucial witness. We have to be able to work something that they [the U.S. attorney representing Obama] can hear what he says, that you can hear what he says, that there is a record of it. . . . If, God forbid, something happens to this witness, at least we will have his testimony here.”

    Carter didn’t oblige. After all, Taitz’s lawsuit against Obama hadn’t even reached the discovery stage, and the defense had been given no notice that she planned to call a witness that day. But Taitz ended up being right about one thing: Smith, who says he obtained Obama’s original birth certificate in Kenya, likely won’t get another chance to testify in Santa Ana. A week after the hearing, he says he has cut ties with Taitz because she asked him to lie under oath, making him the latest in a string of “birthers” to publicly criticize the woman who has become the face of the movement.

    “I finally told her to forget it, we’ll part ways,” Smith told the Weekly on Sept. 16. “I definitely do not want anything to do with this dentist/wannabe movie star.”

    Smith, 29, first appeared in the birther world in June as eBay user “colmado_naranja.” He was holding an auction for an artifact he claimed to have found: Obama’s original birth certificate from Mombasa, Kenya. After opening and closing the auction a few times, Smith in late August posted a video on YouTube showing himself surrounded by black children and holding the purported birth certificate. Right-wing news site World Net Daily—the organization that has sponsored “Where’s the Birth Certificate?” billboards across the country, including one in Buena Park—pounced on the story, reporting that Smith has a criminal record that includes forgery and an attempt to sell his kidney, and calling the certificate “not a valid document.”

    In early September, Smith fired back at World Net Daily with a series of YouTube videos before filing a declaration with Taitz’s Barnett v. Obama lawsuit, vouching for the authenticity of the Mombasa birth certificate and saying he had obtained it by paying off a military officer in Kenya. Taitz paid for Smith’s plane ticket from the Dominican Republic, picked him up and brought him to court on Sept. 8, where he believed he would be given a chance to speak. A week later, though, Smith posted a message on his YouTube channel: “Im sorry everyone but, [sic] I cannot work with Orly Taitz any longer. She wants me to lie under oath.”

    Smith isn’t the first in the Obama-conspiracy world to quarrel with Taitz. In May, Pennsylvania lawyer Phil Berg teamed up with his assistant, Taitz’s former webmaster and an online-talk-show host to sue Taitz for slander, harassment and privacy violations (see “Birth of an Obsession,” June 18). Buena Park pastor Wiley Drake and American Independent Party chairman Markham Robinson, after originally being represented by Taitz in their lawsuit against Obama, changed their attorney to San Diego lawyer Gary Kreep. He, in turn, has become a source of ridicule on Taitz’s website. At the Sept. 8 hearing, Carter said he would “force” the two attorneys to work together. “Your personal likes or dislikes or inability to work together isn’t a good reason for the court to allow separate lawsuits to proceed,” he said before asking Taitz and Kreep to move their chairs together.

    That conflict ultimately led to the falling-out between Smith and Taitz, Smith says. Taitz supposedly asked Smith to testify in court that Kreep had approached him months ago to buy the Kenyan birth certificate from him, with an interest in preventing it from ever being filed in a lawsuit. Smith says she also asked him to vouch for the veracity of another Kenyan birth certificate that Taitz has filed as an exhibit in her lawsuit—the same certificate that won Taitz headlines around the world in August as quickly as it was debunked as a likely forgery.

    “I’m not going to discredit my own story for her lawsuit,” Smith said. “Let’s not fight lies with lies.”

    Muslims from Britain, Sweden, and now Germany are reportedly fighting against NATO troops in Afghanistan. Recently investigators have discovered a village in Waziristan, near the Afghan border, which is full of white muslim converts.

    Afghanistan is not the only destination for muslims from Western countries. Muslims from the US, Canada, Britain, Sweden and Holland are presently waging jihad with al Shabaab in Somalia.

    A recruitment video presents life in the village as a desirable lifestyle choice with schools, hospitals, pharmacies and day care centres, all at a safe distance from the front.

    In the video, the presenter, “Abu Adam”, the public face of the group in Germany, points his finger and asks: “Doesn’t it appeal to you? We warmly invite you to join us!”[…]

    The Islamic Movement of Uzbekistan, which has a foothold in several German cities, has capitalised on growing concern over the rising profile of German forces in Afghanistan. Their role has become increasingly controversial in Germany in recent weeks after dozens of civilians were killed in an air strike ordered by German officers.

    Last night a foreign ministry spokesman told The Daily Telegraph they were now negotiating with Pakistani authorities for the release of six Germans, including “Adrian M”, a white Muslim convert, his Eritrean wife and their four year old daughter, who were arrested as they were making their way to the “German village”. They are particularly concerned about the welfare of the child.
