Two gorgeous women in a glorious setting – Cindy McCain and Sarah Palin in Sedona, Arizona

September 30, 2008

While Biden was in Wilmington, Del., on Tuesday rehearsing for his second day in a row, Palin stepped off the campaign trail for two days of sequestered debate preparation at John McCain’s ranch in Sedona, Ariz.

Palin was surrounded by senior McCain advisers, including Steve Schmidt and Mark Wallace, as well as McCain’s wife Cindy.

(Lafayette Hill, Pennsylvania – 09/29/08) – Philip J. Berg, Esquire, the Attorney who filed suit against Barack H. Obama challenging Senator Obama’s lack of “qualifications” to serve as President of the United States, announced today that he filed his Opposition and Brief to Obama and Democratic National Committee [DNC] Joint Motion to Dismiss in the case of Berg v. Obama, No. 08-cv-04083.

Berg feels confident that he has “Standing” and the Court will allow the case to go forward. Our response was due in 14 days, but the Court requested our answer by Monday, September 29, 2008 and we complied.
In our response we set forth sufficient reasons that I have “Standing” to bring this lawsuit. Furthermore, I set forth additional reasons that indicate Obama does not meet the qualifications for President of the United States and Obama should be removed from the ballot and held accountable.

Our website obamacrimes.com has received 17.1 + million hits. We are urging all to spread the word of our website – and forward to your local newspapers and radio and TV stations.
Berg again stressed his position regarding the urgency of this case as, “we” the people, are heading to a “Constitutional Crisis” if this case is not resolved forthwith.

“St. Louis Prosecutor who joined Obama ‘Truth Squad’ pleads innocent”

This kind of cynicism belongs in the Hall of Fame of Shame.

St. Louis prosecutor Jennifer Joyce, member of the Obama “Truth Squad” in Missouri made up of members of law enforcement pleads innocent to charges of intimidation of political foes.

The Political Fix has her statement:

As a citizen, I believe that elections should be about issues. I also have enormous respect for our First Amendment and freedom of speech. My sole purpose in participating in this initiative is about getting truthful information to the voters. This has never been or never will be about prosecuting people.

Clearly there are those who are attempting to twist the purpose of this initiative for their own benefit. This attack is a great example of how the truth is distorted in campaigns and what we’re trying to stand up against.

Nice strawman, Jennifer. No one on this side is talking about prosecution either – only the threat of prosecution which everyone knows is a time honored tactic of prosecutors who desire a certain result in court but can’t prove wrongdoing.

In this case, there’s a little old thing called the First Amendment that stands in the way. But that wouldn’t stop an aggressive prosecutor from sending letters hinting that opponents could be arrested if their version of the “truth” were in conflict with the official Obama line.

We know all this which is why Joyce’s statement is so incredibly self serving. And it’s also just one more piece of evidence that the Obama camp arrogantly takes unto itself the ability to quash free speech whenever it is convenient for them.

Welcome to change you can be intimidated to support.

There is an alleged 1999 incident where Obama received oral sex from Larry Sinclair and smoked crack and snorted cocaine.

Larry Sinclair willingly accepted a polygraph to prove that he was telling the truth.

However, the organization that ran the test used an “expert” with phony credentials.

They never released the results of the second test which was analyzed by a real expert.

Sinclair passed the automated polygraph. (Yes, there is a God. This is so heartening to read this after months of intentionally being misled.)

The organization (Whitehouse.com) is a partisan, pro-Obama organization run by a pornographer.

We already know that Obama will not volunteer to submit to a polygraph and he refuses to provide proof of his whereabouts on the date in question.

Given that Obama admitted in his books that he once used cocaine and crack, the Sinclair allegation is that much more believable.

“Obama Truth Squads Try To Take Down Video Depicting Dems as Responsible for Economic Crisis”

From: IIMoses740II

Partial Transcript:

Barack Obama’s heart may be in the right place, but his head is not.

His friends caused this. His political philosophy caused this.

And now he lectures the country about “failed economic policies.”

And he ridicules John McCain.

This is not change. This is more of the same.

This is hypocrisy! Or hope – o – crisy!

And hope is not a strategy.

This crisis started growing in 1995.

But it ends now!

Because change is on the ballot!

Change is on the way!

Mr. Berg provides precedents which he argues establish his standing and petitions the Court to deny dismissal and order the defendants to produce the documents in the previously requested discovery.

What does it all mean?

If I’m thinking like Obama, I’m betting that the Judge’s haste in obtaining Berg’s response to my Motion to Dismiss means that he could be ripe and ready to toss the whole thing out on jurisdiction issues should Berg not respond with anything new. If I’m thinking like Berg, it means that the Hon. R. Barclay Surrick could possibly grant my Motion for Expedited Discovery and delay ruling on Obama’s Motion to Dismiss until further evidence comes to light.

Bear with me here.

On questions of subject matter jurisdiction, I’m fairly certain that Judge Surrick can indeed delay a decision on Obama’s Motion to Dismiss and order discovery in the interim. In fact, according to a 2002 case entitled Sizova v. National Institute of Standards & Technology, when a defending party files a Motion to Dismiss for lack of jurisdiction, either party should be allowed discovery with regard to the issues of fact raised in that dismissal motion. Now, Judge Surrick certainly has discretion as to how he proceeds with adjudicating the issue of subject matter jurisdiction, but if he refuses discovery in such a way that the refusal could be deemed prejudicial against Berg, the denial and inevitable dismissal could be appealed on the grounds that the Judge abused that discretion.

Obviously, these things go both ways. Some decisions hold that, as a general rule, courts should allow limited discovery before dismissing a suit for lack of subject matter jurisdiction, while others hold that given the wide discretion afforded to District Court judges, the granting of a Motion to Dismiss based upon lack of subject matter jurisdiction without discovery does not constitute error.

This whole process will take time. Berg, of course, is fairly confident that he’s doing the right thing and will come out on top.

“In no way, shape or form does Barack Obama meet the requrements for president of the United States, and he should immediately be taken off of the ballot” Berg said. “Also, since he taught Constitutional Law, since he wrote the books that he wrote, he must be aware of his situation. It’s a crime what he’s done, and the Department of Justice should look into it.”

UPDATE:

The motion was filed shortly before 5:00 p.m today, along with a dozen exhibits. Upon cursory glance, it looks the same as when I saw it this morning. The full text of the motion, in PDF format, can be found by clicking HERE (many thanks to a good friend of America’s Right).

Lao Tze (Larry Martin) maintains Barack Obama is Indonesian and he and TexasDarlin both have questions.

http://texasdarlin.wordpress.com/2008/09/30/obama-is-indonesian/

http://laotze.blogspot.com/2008/09/obama-throwing-papau-under-bus.html

Martin, as conveyed via email to me, thinks it’s time to ask Congressman Eni Faleomavaega a few questions:

1) What was the purpose of visiting Obama’s childhood school?

2) How much money was given to Barack Obama’s school, and why?

3) Why was there no mention of his trip to Indonesia and, considering his previous position, why was there a complete shift of his position on autonomy for the residents of Papua?

4) What did he discuss with the President of Indonesia regarding Barack Obama?

And MY QUESTIONS:

1) What is the current status of Obama’s Indonesian citizenship? Was it ever repudiated? If so, when? Martin wrote that “Obama is (not was) Indonesian. [Keep in mind from Judah Benjamin’s work that Kenyan citizenship, which Obama has now admitted acquiring at birth, automatically expired, but he would have had to formally renounce Indonesian citizenship by age 21.]

2) What was the nature of the records that were “acquired” by the US delegation, and how were they “suppressed?”

I have no additional information at this time.  This report will be updated if/when new information is received.

John McCain “The U.S. Congress needs to back a short-term plan that can restore confidence.”

September 30, 2008

Short-Term Memory

From: JohnMcCaindotcom

http://www.reuters.com/article/marketsNews/idUSN3036324920080930

WASHINGTON, Sept 30 (Reuters) – Republican Sen. John McCain on Tuesday backed increasing the limit on bank deposits guaranteed by the federal government to $250,000 from its current level of $100,000.

In an interview with CNN, McCain said he spoke to President George W. Bush on Tuesday morning and recommended that Federal Deposit Insurance Corp. limits be raised to help protect Americans’ bank deposits.

McCain’s opponent, Democratic Sen. Barack Obama, made a similar suggestion on Tuesday in a statement.

“Also the treasury has the ability to buy up a trillion dollars worth of mortgages. We should move forward on that as we are crafting this rescue bill,” McCain said.

A day after the House of Representatives failed to approve a $700 billion Wall Street bailout, sending the U.S. stock market into a tailspin, McCain said the U.S. Congress needs to back a short-term plan that can restore confidence.

“We’re not going to get a unanimous vote. But I’m convinced that yesterday’s events and reactions of $1.2 trillion being wiped out .. Americans are frightened right now,” he said. “We’ve got to give them a short-term plan … then a long term plan.”

“The End of the U.S. Financial System as We Know It?” [Larry Kudlow]

September 29, 2008

On Wall Street, according to preliminary calculations, the Dow fell 777.68, or 6.98 percent, to 10365.45.

http://corner.nationalreview.com/post/?q=ZmU5YTUwYWZiMzUzNmM1MDcxNDQ1MmQ4ZWE2MWVlNWM=

A number of Republican House members and staff, along with others who are plugged in, are telling me that Nancy Pelosi and the Democrats will come back with a new bill that includes all the left-wing stuff that was scrubbed from the bill that was defeated today in the House.

As this scenario goes, the House Democrats need 218 votes, and they have to pick up a number of black and Hispanic House members who jumped ship because the Wall Street provisions, in their view, were too benign. So things like the bankruptcy judges setting mortgage terms and rates, the ACORN slush-fund spending, the union proxy for corporate boards, stricter limits on executive compensation, and much larger equity ownership of selling banks through warrants will all find itself back in the new bill. Of course, this scenario will lose more Republican votes. But insiders tell me President Bush will take Secretary Paulson’s advice and sign that kind of legislation.

Personally, if this scenario plays out, I would probably withdraw my support for the rescue mission and switch to plan B, which would center on the FDIC and its bank-recapitalization powers. The bank-ownership issue, in particular, could lead to heavy nationalization of America’s financial system with a three-house Democratic sweep in November.

I’m not forecasting, because I don’t know the next bill’s content. And while McCain’s polls are heading south, he could still win. But a three-house Dem sweep to implement some off the very onerous provisions being talked about could set up the end of the U.S. financial system as we know it.

I’m gonna wait and see. Obviously, the financial markets are in total collapse today. And the economic outlook is suffering.

Tough day. One of the worst I can remember.

Welcome back to Sedona, Governor Palin! “On Monday afternoon Palin will travel from Columbus to Sedona, Arizona”

September 29, 2008

http://afp.google.com/article/ALeqM5htBEKvL1Ns57f_cE0v-T9zt9SEkA

COLUMBUS, Ohio (AFP) — Republican White House hopeful John McCain on Monday defended his running mate Sarah Palin amid growing criticism of the vice presidential nominee, telling supporters “she’s going to be my partner in Washington.”

McCain devoted the beginning of his speech to praise Palin , in the first rally since he announced the suspension of his campaign last week in response to the country’s financial crisis.

“She’s a bit of a maverick herself,” McCain told the rally in Columbus, Ohio.

“She’s going to be my partner in Washington. She’s a leader and knows what it means to put country first,” he said.

Palin has faced rising criticism in the press, including among conservative commentators, for avoiding the media over the last four weeks. The attacks have also expressed doubts about the Alaska governor’s potential ability to serve as vice president.

Her Democratic counterpart, vice-presidential candidate Joe Biden, has given over a hundred interviews with national and local media since being nominated in late August.

Palin has given three interviews, including her most recent interview with CBS News last week that has prompted calls, even among some former supporters, for her to step down as the nominee.

Conservative columnist Kathleen Parker wrote this week that “Palin is clearly out of her league” and called for her to leave the race.

Speaking at the Columbus rally alongside McCain, Palin said: “Here in Ohio, the high price of gas is making a full tank seem like a luxury.”

She told Ohio supporters the McCain-Palin ticket would mine coal resources in the region, in contrast to their Democratic opponents.

On Monday afternoon Palin will travel from Columbus to Sedona, Arizona — where McCain owns property — to prepare for the vice presidential debate on Thursday.
