‘India has been rattled by Mr Obama’s comment that US should help resolve Kashmir problem’

Ahmed Rashid is the author of the recently published Descent into Chaos: How the war against Islamic extremism is being lost in Pakistan, Afghanistan and Central Asia.

Listen to Mr. Rashid comment on recent Mumbai massacre and the real terrorist intent – which is to pull Pakistani troops away from Afghan border in order to secure a terrorist safe haven there. Mr. Rashid comes in just after 4:45.

Pakistan issues

Pakistan has the severest political and economic crisis in its history.

It also faces a jihadist insurgency that is spreading beyond northern Pakistan, an army that is still hesitant to cede too much power to a civilian government and an ubiquitous intelligence service that runs a state within the state.

There is also a division within the establishment.

Traditionally the ruling Pakistan Peoples Party has been close to the Democrats, while the army has always preferred the Republicans – perhaps because Republican presidents rarely question military rule.

Despite the efforts of President Asif Ali Zardari, the US-Pakistan relationship is at a low ebb due to the US belief that the army is not fully confronting the jihadist threat.

Mr Obama will need a comprehensive policy for Pakistan that both strengthens democracy, woos Pakistan‘s main street by a more people-orientated aid program, while ensuring that the army remains a US ally and is not alienated.

Mr Obama will have to combat the deep anti-Americanism that Mr Bush’s policies created amongst the public, media and the army.

This anti-Americanism is being exploited by the jihadists who attack democracy, women’s rights and other freedoms as belonging to Western rather than Islamic value systems.

Both Afghanistan and Pakistan will have to also wake up to another reality.

Gone are the Bush days when US government aid was doled out with little accountability or few conditionalities.

Eighty per cent of the $11.8bn funnelled to Pakistan since 2001 was gobbled up by the army with an unprecedented lack of transparency or accounting by either Islamabad or Washington.

Some of the over $20bn of US aid to Afghanistan has been siphoned off to fuel local corruption, pay expensive American consultants or carry out over-billed development projects.

While the international financial crisis will make every US penny count, the new Democrat administration has pledged to better monitor and account for all US aid.

A bill introduced before Congress by now Vice President-elect Joe Biden, which promises Pakistan $1.5bn a year for development aid for five to 10 years is heavy with conditionalities.

The aid money will only flow if Islamabad strengthens democracy and fights terrorism.

India rattled

India is waiting to see how President Obama deals with the nuclear agreement signed with Bush.

India has already been rattled by a comment by Mr Obama on CNN that the US should help resolve the Kashmir dispute.

The Indian media has criticised an essay that I wrote with fellow Afghan analysts, Barnett Rubin in Foreign Affairs magazine this month urging the US to pressure Delhi to do more to resolve its disputes with Islamabad so that the Pakistan army could feel less threatened by India and divert more resources to fighting militancy.

India‘s foreign ministry is now sending a delegation to meet with the Obama transition team.

India has traditionally refused to accept outside pressures on improving its relationship with Pakistan, but negotiations on resolving the Kashmir issue have been paralysed since the 2004 ceasefire – largely because India refuses to discuss the issue.

However if Mr Obama is to pursue a comprehensive strategy to help Pakistan and Afghanistan combat jihadism, India will have to play a role and be part of the solution.

  8. Foxtrot Says:

Someone by the name of “Linda Starr” on another blog is absolutely certain that one of these lawsuits will pan out and that Obama will not be allowed to be sworn in. She makes a good point that Roberts would be the one that has to swear in Obama for the Presidency, and unless he concretely knows he is eligible, he won’t want to do it. They think that will be enough for him to at least ask for the long version of the birth certificate and potentially the release of his college records.

I also read that Obama had added verbage to the clause that allowed McCain to move forward with his candidacy, that would also incorporate anyone who had one parent who was a U.S. citizen, regardless of where they were born. I will try to find the link. If that is the case, we are in deep do-do!

  11. Foxtrot Says:

I know what you mean JAC! I am exhausted!

  12. justanamericancindy4 Says:

I’m waiting to see if the full page ad is indeed in the Chicago Trib….then i will get in my car and run down to the station and get a newspaper…

  13. Foxtrot Says:

I think it is actually an insert, instead of an ad in the paper itself. I may be wrong, but that is my understanding. Therefore, it may not be included in the paper outside of the state. My 3 daughters live in Chicago. I am going to ask them to buy a paper for me and let me know tonight.

I hope you are correct about the language. I think this guy has been trying to set this up from the get-go!

  17. tooncesmom Says:

Question: I know there’s something fishy about BO not releasing the college records (and we probably all know why), but is there a reason these need to be seen in order for him to be sworn in? Am I missing something here?

  18. justanamericancindy4 Says:

South Carolina and Tennessee are wanting poof BO qualifies before their Electoral vote…….. I have read this a couple of places…but I have yet to track down the original source.

  19. Cyndi Says:

Did anyone see that video of Colin Powell saying that we would see a crisis on Jan. 21st or 22nd. Hmmm the day after the inaguration, however he doesn’t say what the crisis might be and the reporter doesn’t ask him about it.

  20. Foxtrot Says:

Toon, Yes there is a reason. It goes to his citizenship again. In the event it is discovered that he is NOT a U.S. citizen (which we all know he is not), then he will probably blame his dead mother for not having told him, and that he did not know, or some such craziness. If his applications to his colleges showed he applied as a citizen of another country, he was then an adult and cannot try to weazel out of it!

  21. justanamericancindy4 Says:

Many of you know that visualization is a very strong tool and it works in a positive or negative manner (depending on where you put your energy).
In this case-what we don’t want is Obama being sworn in as our next president, right?
So anyone who is willing, please visualize the Justices demanding the vault version of BO’s BC.

You want me to state something with a degree of certainty? How’s this? I know for a fact his mother’s Indonesian husband adopted Obama. His legal name is Barry Soetoro. Just like I know for a fact Bush was AWOL. Just like I know for a fact he falsified personnel readiness reports to the Pentagon carrying 1700 ghost soliders on the payroll of the TNG while Governor of Texas. Just like I know for a facot he got a new drivers license number on march 31, 1995 to cover up his criminal drug arrest records. His new number is now 0000005. If you doubt it, call the TDPS and ask if his number is in fact all zeros and a five.

I have been performing oppositional political research agaisnt the GOP for over 10 years. Now that I’m exposing their boy, the Dems aren’t so happy with me these days, but that does not diminish the quality of my research work. Obama was born in Kenyan, makin ghim a citizen of Kenya until his mother’s Indonesian husband adopted him and he became a citizen of Indonesia. Sorry if that bothers you. You’ll have to wait for court to fin dout how I know. Did I mention I’m the person who took this case to Phil Berg? I KNOW the facts of his case and the evidence it is based upon. You’ll all see soon enough. This case is gold.

  31. Melissa Says:

The Senate Resolution Bill regarding McCain’s ‘natural born’ status doesn’t mean anything. They don’t get to interpret the Constitution and determine who is eligible. We all see what happens when they TRY to interpret the original intent of the document. They fail. The privilege of interpreting the Constitution is reserved for our honorable Supreme Court Justices.

I am worried about South Carolina and Tennessee trying to ‘qualify’ Obama now. If there is actual proof that he was born in Hawaii they may just assume he’s natural born without taking into consideration the fact that he was born a dual citizen. These people clearly aren’t the best and brightest if he made it on the ballot to begin with. At least it’s a step in the right direction though.

Cort Wrotnoski makes some excellent, easy-to-understand, statements of fact in his case. Also, he is not asking the Supreme Court to allow the case to be sent back to the lower courts of CT. He said he recognizes that this matter is far too complicated to be solved in anything less than the Supreme Court. Hopefully the Justices concur.

Obama has had some pretty negative things to say about Justice Clarence Thomas and Justice John Roberts. The quote below is from Obama regarding the confirmation of John Roberts:

“Let me also say that I remain distressed that the White House during
this confirmation process, which overall went smoothly, failed to
provide critical documents as part of the record that could have
provided us with a better basis to make our judgment with respect to
    the nomination.

This White House continues to stymie efforts on the part of the Senate to do its job. I hope with the next nominee who comes up for the Supreme Court that the White House recognizes that in fact it is its duty not just to the Senate but to the American people to make sure we can thoroughly and adequately evaluate the record of every single nominee who comes before us.

Justice Souter of the Supreme Court has ordered President Elect Obama to produce a ‘vault’ copy of his birth certificate by Dec 1st 2008. This is the same document that up until now the Obama legal team has fought showing to the American public. It is widely rumored that Obama was born in Kenya and his vault copy of his birth certificate will say this. Hence his legal maneuvering to not let the public see it. The Supreme Court will not let this go.

What the actual law says about citizenship in Obama’s case history…
written by Linda Starr, November 30, 2008

    Here’s the url …

Click on “US citizen services”, upper left corner. Then click on “Child Born in Wedlock Abroad” in the left hand column, about halfway down…

“Acquisition of U.S. Citizenship By a Child Born Abroad

Birth Abroad to Two U.S. Citizen Parents in Wedlock: A child born abroad to two U.S. citizen parents acquires U.S. citizenship at birth under section 301(c) of the Immigration and Nationality Act (INA). One of the parents MUST have resided in the U.S. prior to the child’s birth. No specific period of time for such prior residence is required.

Birth Abroad to One Citizen and One Alien Parent in Wedlock: A child born abroad to one U.S. citizen parent and one alien parent acquires U.S. citizenship at birth under Section 301(g) INA provided the citizen parent was physically present in the U.S. for the time period required by the law applicable at the time of the child’s birth. (For birth on or after November 14, 1986, a period of five years physical presence, two after the age of fourteen is required. For birth between December 24, 1952 and November 13, 1986, a period of ten years, five after the age of fourteen are required for physical presence in the U.S. to transmit U.S. citizenship to the child.”

Basically, the US law in force at the time dictates Obama was a citizen of Kenya, not the US if born in Kenya as we believe. His paternal kenyan grandmother insists she was in the room when he was born in Kenya. Her statement is actual evidence. It’s not an Internet rumor. It has been established by sworn affidavit by witnesses who interpreted the conversation.

Then to complicate matters further for Obama, when his mother’s Indonesian husband adopted him, he BECAME A CITIZEN OF INDONESIA! That was never reversed or undone, nor was he formally adopted by his grandparent’s. He cannot serve or be sworn into office.
He is not even a citizen of this country.

Further, Obama has been boxed in by Phil who filed a “False Claims Act” complaint in DC in a case of fraud against Obama in falsely collecting pay for his office as a US Senator if he was not an eligible citizen. He can go to jail for fraud for ALL the public taxpayer supplied pay he received as an Illinois state and a US Senator. If he doesn’t prove he was an eligible citizen to receive that pay, he can go to jail. Other charges can follow. ANY CITIZEN can file a false claims act complaint. it is usually used in Medicare and Medicaid fraud cases, but can be used to target anyone who received any form of payment from the government fraudulently. If Obama hoped to avoid the compliant by relinquishing his seat as a US Senator, he is sadly mistaken. Fraud is fraud and merely quitting does not absolve him of his guilt in the fraud he perpetuated to get selected in a fraudulent election process skewered to favor him. As long as HRC doesn’t quit her seat, she will be safe, even if Obama is removed. Who knows? She may yet have a few surprises in store for everyone.

We may end up revoting. We may end up with a new Dem ticket. I honestly don’t know what might happen. It depends on when the SCOTUS acts and what/how they decide. I don’t beleive the SCOTUS will not uphold the Constitution for Obama. IMO, if they were to do that, after appointing Bush in 2000, well, there may be a second time in history that the SCOTUS are dragged out and hung. I think too many military will not allow them to fail to uphold the Constitution. I am not advocating it, just stating that is my Constitutionally guaranteed right to express my OPINION. When I have stated my opinions here before, I was accused of advocating violence in this country. For some, expressing an opinion that something might happen, is the same as advocating for something.

One was in 100% until the latest crap with cloud and now she is pretty pissed to have wasted so much time. One has not been involved these past few weeks and has not committed to how she stands. And one is still giving K a chance but will probably come around with FURY.

Cloud the Manipulator and Something About (Telephone) Numbers:

Someone mentioned, perhaps it was you, that Korir himself presented evidence to your group implicating cloud.

(Sorry to be so cryptic here but I don’t know enough to read between the lines and I’m trying to get info out there without revealing identities.)

One of the five still thinks that Korir did not pull those (telephone) numbers “out of his butt.”

cloud had another member of the group convinced Korir did (make shit up)

Korir the Manipulator Playing Both Sides Against the Middle:

Korir tells them (cloud and not sure who else) that he trusts them and that (the inner sanctum?) are the ones making stuff up.

One of the five does not realize how manipulative cloud is.

Apparently one of the five told cloud all and another of the five doubts those (telephone) numbers go anywhere anymore.

One of the five got slapped in the face when she thought that she and ***/cloud decided to walk away from API

BUT cloud ran right back to api in force.

This shocked the one but not enough to convince her that cloud is bad.

Mostly I mean how Korir uses people and then tosses them by the wayside for no apparent reason.

The interesting thing is that he does not involve people who can actually help him – like *** and *** and all those who have offered web design or free radio hosting.

Shouldn’t we put something out there to warn others that may fall into this trap?

One of the five thinks that would be a very good idea.

It’s still possible that MO was stupid enough to call Korir.

One of the five thinks MO did — thought it sounded like MO, BUT thinks the tape was too good to be true and that Korir probably lied about it .

And he may just be milking this for every last drop.

One of the five has not figured out Korir’s motive OR cloud’s.

Either the tape is real and cloud is there as a total OBOT

    or

the tape is fake and cloud is just an anxious person.

Either way, from my perspective, he’s a bad actor.

One of the five believes Korir may be a great con artist!

(So dear readers I put this out there in the hopes that others may not fall into Korir’s trap. I don’t know what his game is. I don’t know if MO ever called him or, if so, if he actually has a recording of her.

But I can tell you from experience that he uses people and tries to manipulate them. This definitely includes the Group of Five.

As far as cloud is concerned, between her and Korir, I don’t know who is manipulating whom. Perhaps they deserve one another.

I know for a fact the Group of Five considered cloud an Obot and that Korir concurred with them and even presented his own evidence implicating her.

I’m inclined to give cloud the benefit of the doubt as it really doesn’t matter much anymore.

But Korir is no good – tape or no tape.)

    Hello All,

    My last post to you
“Hillary and Senate Democrats Invalidate the Constitution!” showed how Obama is flat out ignoring the Constitution by appointing Hillary Clinton as Secretary of State. I have written a letter to all my House and Senate Representatives imploring them to not support this appointment because of the Constitution and it’s Original Design. I have included that letter and a link so you can very easily do the same. In that link, just place your zip code in the open box click “GO” and you will be taken to a site where writing to your Representatives will be just a few clicks away. On the “Action Alert” page in the “Write Your Elected Officials” section click on the “Federal” link. Then just cut and paste my letter, or you can add or delete what you wish from it, or write your own and send that letter to all your Rep’s with just one click. YES IT IS THAT EASY! Note: Keep in mind you will need to add you own Address, Not Mine. LOL!

Remember: “Most of the problems we face in America today are because the government “Runs Free” and most of “We The People” run silent. The Constitution only works when everyone gets involved. Shane 2007”

    Hello Congressperson,

The President elect, Mr. Barrack Obama, Has just appointed Mrs. Hillary Clinton as Secretary of State. I am imploring you to NOT support this appointment on the grounds of the U.S. Constitution where as Mrs Clinton Voted during her term as Senator to increase the Emolument of the Secretary of State. The Constitution states very clearly that:

    Article I Section 6:

No Senator or Representative shall, during the Time for which he was elected, be appointed to any civil Office under the Authority of the United States which shall have been created, or the Emoluments whereof shall have been increased during such time; and no Person holding any Office under the United States, shall be a Member of either House during his Continuance in Office.

Our founding father’s debated long and hard over all the principles of the Constitution. I have always believed in the Constitution, it’s principles, and it’s original intent even when I may not like it. They are the foundation and security of this nation, and the reason why we are the strongest country ever in the history of the world. To just ignore one of it’s founding principles would strongly weaken the Constitution and this country.

Please, Stand up for the Constitution and its founding principles and do not support Mrs. Clinton’s appointment as secretary of State.

    Thank You, Shane Revill

I wrote two letters to each Justice. One regarding Berg and the other Donofrio.

Signed, sealed, and delivered last week.

What p*sses me off is the fact that these politicians are walking all over the constitution. They only use it when it benefits them. What set the USA out from any other country and what once led us to be the great nation that WE WERE is owed to our Constitution. And these idiot politicians better wake up and remember it.

Gathering of judges will meet on Dec. 5 to decide whether or not to hear a case from New Jersey, and a decision is still pending on a case from a lawyer in Pennsylvania. Should four of the judges vote to hear the case in the Dec. 5 meeting, then it will be scheduled for hearings. Court cases from Connecticut and New York have also applied for hearings at the U.S. Supreme Court.

Oh, and I faxed a special letter to Justice Thomas last week as well. I am sure they have been inundated with letters and faxes over this issue.

Justice Thomas knows that there are many of us that still value our Constitution. He said so in a speech he made our Government and the Role of the Constitution.

He also stated that they take what the Framers said AS LAW. These Justices know what the Framers meant when they said natural born citizen.

Like the Trib here……. I don’t think a 1/4 page ad would cost much

  77. Foxtrot Says:

Good idea JAC, but still expensive. Even in our podunk newspaper here it is around $400 for a 1/4 page ad. Crazy, huh?

Melissa, how did you get a fax number? I called the Court and they said they don’t accept faxed letters and that they are tossed if they come in. That is why I sent hard copies via Fed Ex to each of them. I spoke to one of the clerks for Roberts.

Guess you heard that Leo Donofrio requested time last night on Plains Radio for an announcement.
What I got from the show – the South Carolina Board of Elections has sent a letter to their electors instructing them to definitively verify the eligibility of Obama PRIOR to their electoral college vote. Plus, Tennessee is having a conference call with all their electors for this as well.
As one goes, others will follow, so it looks like Obama WILL be required to prove his eligibility and that he is a natural born citizen to the Electoral College.
As you know, this is potentially huge! The show will be available today at the Plains Radio archives.

Cannot wait until all of these hot-button issues are resolved one way or another…we have an economy on life-support and we are at war in two hotspots abroad, so the sooner we resolve the court challenges, the President-elect, or the individual who emerges out of any signifigant revelations that derail Mr. Obama’s present political-status, may begin to focus on the job at hand–winning the wars and reviving the economy.

Please remember that I lost faith with Korir when he published at API the whole mole thing.

I along with the Group of Five knew he was referring to cloud.

One of the things I haven’t published is the dialogue between cloud and hope suggesting I was the mole.

And you may have seen the not so nice comments made about me at API or here at RS and of course you wouldn’t have seen the ones I just deleted.

Korir broke faith with me and then plays the martyr card.

The last notation that was added today about the supplemental brief filed, as Leo explained in the interview I’m listening to from last night, is simply him informing the court that he was involved with Cort’s case (from CT) and that it is similar so they should look at that case as well.

It is simply up for conference, which means all of the justices will give their opinion on the matter and depending on the opinions it will or will not be set for trial arguments…The supplimental brief was Leo, informing the court that he is working on the Cort Wrotnowski case as well.

Noooo, I’m not saying that President-elect Obama has anything of real substance to worry about, only conceding that whether words can break his bones/spirit or not, that the full-page ads, the various court-proceedings, etc. may simply take a heavy toll on him this week. My bet though is that by 5pm on Friday, December 5, 2008 he is still standing tall. And your wager, Ma’am, is?

Hope all is well and life is treating you well. Hope you and your hubby had a joyful and memorable holiday celebration, Susan.

API is done. I personally spoke to Phil Berg and Lisa and they both told me they had never received the tape, that is why they broke away from API–they think they are phoney.

    ————————-

This is what confuses me, Fox.

I know MommaE is in touch with Berg.

If Berg has distanced himself from Korir, then why on earth is MommaE back on board?!

The only thing I don’t like about the ad is that it requests Obama submit those documents to him at the Press Club. Won’t that give Obama time to “doctor” up the documents? I know earlier in the ad it states they want certified documents, but then later it contradicts that, doesn’t it?
    ————————————————————-
I can assure you that Obama has had doctored up documents lying in wait for quite some time now.

IMO I don’t want the BC issue to get attention. I think that all of BO’s thugs could cover and “generate” a legit looking BC and cover any evidence up that it is fake.

It will be much harder to cover up the dual citizenship issue.

  148. justanamericancindy4 Says:

I just wish the ad mentioned the $500,000 he has used of campaign money (my guess that is campaign $$) to legally hide his BC and Documents

I for one don’t understand why any fingers would have been pointed at you. IMO you are honest and never mince words, it is what it is with you. That is why i trust what you say, no added fluff ;)

    Thanks, Ks!

  150. Foxtrot Says:

It will be interesting to see how the people who have been clueless up to this point, about this story, will react to the ad. I hope many Letters to the Editor follow this ad up there and it sparks a national, open discussion among the MSM. AHHHHHHHHHHHH . . . dare to dream!

  152. Foxtrot Says:

Rose, don’t get me wrong here . . . I like Momma E. But if someone strokes her ego a bit and says nice things, she will crumble. I have seen it over and over with her. I love how supportive she has been of Berg but she has been “snowed” by Korir. I feel she wants to believe in the tape so much that she is willing to look the other way relative to logic and an inordinate amount of delay tactics. She will come around.

Rose I guess we will all let those that want to play with API do so. I for one am staying out of there. Sounds like a bunch of back stabbing, and fighting and the real issue which was suppose to be the tape has been put to the wayside now.

    ———————

    Agreed, Cyndi.

I guess there still is a remote possibility that we may just hear MO’s voice someday.

But, IF that ever happens, my reaction will be:

    Thanks for nothing, Korir!

    And Good Riddance!

  154. justanamericancindy4 Says:

the ad fully discusses the citizenship issue…… not just the BC

  155. Foxtrot Says:

If you put enough pressure on a balloon, it will explode. I think we are now experiencing the “pile on” effect, but in a good way! Lately there are more lawsuits filed, the ads are appearing in newspapers around the country, radio shows are discussing it–it is only a matter of time before this “explodes”, even if Obama doesn’t want it to. It simply cannot defy all laws of the universe!

  159. Ksinde. Says:

Troy, I hear you. But my concern is if BO’s and Co. dish out a fake but convincing BC, then all the skeptics and average Joe’s who somewhat followed this case will think, Oh Ok BO is a citizen and will dismiss the dual citizenship cases. Also the MSN will never cover this case if BO produces, it will just give them more reason not to cover this whole disaster.

JustCindy, that is good it covers both sides!

If he produces it then skeptics and supporters alike simply won’t matter….The only thing that will matter is how the SCOTUS interpret the constitution….And what about this scenario: The SCOTUS rules in Obama’s favor, but “we the people” forced him to produce documents and it proved he was born in Kenya….The SCOTUS decision would be a mute point.

    Oh, yes, yes, yes!

That’s how Korir got to me back in May/June.

He asked me to join API.

I still have the email and even forwarded it to my daughter who is a Recruiter for Reuters.

    What a fool believes!

  166. Ksinde. Says:

Troy, what if he produces a bc that says he was born in HI? Even if the BC is a fake, he would not be as stupid as he was and will produce a “good” forgery this time.

  167. Foxtrot Says:

Troy is correct. This needs to be fought on both fronts. Otherwise, Obama will find a way to weazel out of one or the other.

  168. Foxtrot Says:

This is also why the college records are critical. They are not mentioned as often, but critical none-the-less. If the birth certificate does prove he was NOT born in Hawaii, which we suspect it will, then he would immediately claim his mother kept him in the dark or he didn’t know! The college records show his declaration of citizenship when he was considered a legal adult and old enough to know better. If he applied as a “foreign” student, which many of us think he did, it will be on his own volition and he cannot say he was hoodwinked by his mother!

FOX – Thanks for verifying the numbers for me, that to me is a friggin’ give away!! Clear as day makes it a forgery. THAT is something that people need to see. Obama may not have realized that he needed to sign up for the Selective Service (just can’t bring myself to call it the SS :) ) because maybe he didn’t get the reminder as no one knew he was a US Citizen (because he wasn’t!)

Move on and start supporting him” Needless to say i took that person off my list.

I have no interest in publicity.

I said certain official documents pertaining to BO’s status had not been sealed up. I won’t be identifying the evidence until Phil wants it out. Suffice it to say, it’s damning evidence for BO.
Why warn them what has been obtained? Why give them a chance to forge something else?
Let them sweat. We already know they have lawyers spending a lot of time here trying to get info to use to help them. Why show our hand?

Oh my gosh! This is infuriating! Read this letter a blogger received from his Senator when he questioned Obama’s citizenship. The Senator claims that the vetting process occurs two times: one when the voters vote for him in the primary and two, when he wins the general election. This guy is an idiot!!

    Here is the letter:

Here is the letter I just received by email from Senator Mel Martinez:
Thank you for contacting me regarding President-Elect Obama’s citizenship. I appreciate hearing from you and would like to respond to your concerns.

Like you, I believe that our federal government has the responsibility to make certain that the Constitution of the United States is not compromised. We must fight to uphold our Constitution through our courts and political processes.

Article II of the Constitution provides that “no Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President.” The Constitution, however, does not specify how that qualification for office is to be enforced. As you may know, a voter recently raised this issue before a federal court in Pennsylvania. On October 24, 2008, the United States District Court for the Eastern District of Pennsylvania released an order in the case of Berg v.Obama.In that case, the plaintiff, Phillip Berg, raised the same issue that your letter raises regarding proof of the President-Elect’s birthplace. Through his lawsuit, Mr. Berg sought to compel President-Elect Obama to produce a certified copy of his birth certificate.

The District Court dismissed Mr. Berg’s suit and held that the question of Obama’s citizenship is not a matter for a court to decide. The court further noted that voters, not courts, should decide whether a particular presidential candidate is qualified to hold office.

Presidential candidates are vetted by voters at least twice – first in the primary elections and again in the general election. President-Elect Obama won the Democratic Party’s nomination after one of the most fiercely contested presidential primaries in American history. And, he has now been duly elected by the majority of voters in the United States. Throughout both the primary and general election, concerns about Mr. Obama’s birthplace were raised. The voters have made clear their view that Mr. Obama meets the qualifications to hold the office of President.

After he is sworn into office, Mr. Obama will be our nation’s President and I intend to bestow upon him the honor and respect due any man who holds that Office. Yet, I am certain that there will be times when I will disagree and oppose President Obama’s policies. When that happens, you can be assured that I will pursue vigorously what I believe to be in the best interest of Florida and the nation.

I thank you for sharing your views with me and will keep your concerns in mind. If you have additional questions or comments, please contact me. For more information about issues and activities important to Florida, please sign up for my weekly newsletter at http://martinez.senate.gov.

    Sincerely,

  212. thinkingmom11 Says:

So EXACTLY HOW are we, the voters supposed to decide if a candidate is eligible when said candidate refuses to provide information pertinent (and requested by “We the People”) to making such determination???? Answer me THAT, Mel!

  213. Foxtrot Says:

Can you friggin’ believe that letter? If that is the case, someone should send this letter to SCOTUS and show them that the voters do have standing when it comes to Obama’s citizenship because “Mel says so!”. ;)

  214. Cyndi Says:

So from Mr. Martinez’s stand point if any foreigner comes here, runs for president, the public voters are the ones that have the final say if he is eligible. What am I missing here?

  215. Cyndi Says:

So Chavez or Putin could be president here if the voters say its ok? How asinine.

  216. thinkingmom11 Says:

That is absolutely ridiculous!!! The more I think about it the more p*ssed I get. grrrrrrrrr. WE’VE BEEN TRYING to VET him! For crying out loud! If this is how Mr. Martinez feels then he should be furious at Obama’s obfuscation regarding so much of his life and records. HE too, should be demanding Obama release information. And, yes, I do think that if ONE MORE PERSON gets shot down because of friggin’ STANDING – this letter needs to be presented. If NOTHING else, the Supreme Court or SOMEONE needs to determine EXACTLY WHO is responsible for determining a candidates qualifications and to define PRECISELY what those qualifications are.

  217. thinkingmom11 Says:

Cyndi – it is obscene what he said. So I guess if everyone thinks the Governator is “qualified” to be president (maybe the really liked the movies he was in – who knows what people will use to decided what they think “qualified” means) COME ON, MEL! Wake up!

  218. hockeyfan530 Says:

that’s the most ridiculous thing in the world. He’s basically saying even if absolute proof of his ineligibilty comes out now the voters already decided so there is nothing that can be done about it. It’s just crazy. I hope someone really goes after that SSR…that’s illegal now matter when it’s proven. I’m getting even madder now. We are now supposed to do the media’s job and the job of whoever it is that verifies eligibility!? That’s insane! We assume that everyone that is running IS eligible

    BREAKING NEWS…

CONFIRMED BY SCOTUS: DONOFRIO V. WELLS WAS DISTRIBUTED FOR CONFERENCE OF DECEMBER 5, 2008 BY THE FULL COURT UNITED STATES SUPREME COURT AFTER FIRST HAVING BEEN REFERRED TO THE COURT BY JUSTICE THOMAS

by Bob Vernon, Honest American News – Radio Plains Network

    December 1, 2008

On November 19, 2008, the official United States Supreme Court Docket for case number 08A407 – Leo C. Donofrio v. Nina Mitchell Wells, Secretary of State of the State of New Jersey – was updated show that the “emergency stay application” to halt the Electoral College meeting of 2008 was re-submitted Donofrio, after having been previously denied by Justice Souter, was “DISTRIBUTED for Conference of December 5, 2008.” At that time, it was not clear whether this was scheduled for conference by Justice Thomas alone or by the full court.

In multiple interviews with Leo C. Donofrio, this reporter and other members of the Plains Radio Network, were informed by Mr. Donofrio that he suspected the distribution for conference was an action taken by more than Justice Thomas alone. Mr. Donofrio suggested that another docket update stating the emergency application was referred to the full court by Justice Thomas should have appeared on the docket prior to the distribution for conference.

Since the docket did not reflect a prior referral it was widely accepted that the distribution for conference was an act of Justice Thomas alone. Honest American News can now confirm – by direct contact with the Supreme Court’s Public Information Office – that the distribution for conference of DONOFRIO V. WELLS was an action taken by the full court.

On November 28, 2008, the docket for case number 08A407 was updated to show, retroactively, that Justice Clarence Thomas did in fact refer Donofrio’s emergency stay application to the full court on November 19, 2008. Last night in an interview with Ed Hale for Plains Radio Network, Mr. Donofrio suggested that this new update, none days later, indicated that the full had taken action to distribute the case for conference. Mr. Donofrio cited a SCOTUS public information document issued to reporters entitled:

A REPORTER’S GUIDE TO APPLICATIONS Pending Before The Supreme Court of the United States

    http://www.supremecourtus.gov/publicinfo/reportersguide.pdf

In that document, on page 3, it advises:

“The Circuit Justice may act on an application alone or refer it to the full Court for consideration. The fact that an application has been referred to the full Court may not be known publicly until the Court acts on the application and the referral is noted in the Court’s order.”

Mr. Donofrio pointed out in various interviews that since his case had been made public by the SCOTUS, there was probably a referral by Justice Thomas prior to the actual distribution for conference. Mr. Donofrio was correct.

Today, I spoke with Ms. Patricia McCabe-Estrada, Deputy Director of Public Information at the United States Supreme Court. She informed me that Mr. Donofrio’s application was first referred to the full Court by Justice Clarence Thomas on November 19, 2008. After that referral took place the full Court, and not Justice Thomas alone, distributed the application for an emergency stay for Conference of December 5, 2008.

Let me reiterate my understanding of the main point as per the phone discussion, DONOFRIO V. WELLS was distributed for conference of December 5, 2008 by the full Court after a prior referral of the application by Justice Thomas.

Mr. Donofrio will be on the Plains Radio Network tonight. See http://www.plainsradio.com for details.

Well, now, that is what I like to hear! I think….I SOOO don’t understand SCOTUSspeak. Does this mean that all (or 4?) Justices want to have a look-see at what Mr. Donofrio has been up to? I have a feeling that they are going to hear this case. Why would they pass up a chance at making a LANDMARK decision? (I can think of some reasons I wouldn’t want to – but this IS their job. This kind of case is why they are there in the first place.

leo is exhausted and feeling beat up…… he is venting he is just soooooo angry how the SC is doing and feeling like a lone solder

cindy, did I miss something? is he gonna be a plumber now ? :-)

anyone going to call ed’s show

  296. thinkingmom11 Says:

OK – I am really feeling stupid because Leo’s point just sunk in COMPLETELY for me. They had to grandfather themselves in because most of the Founding Fathers WERE born on American soil BUT had held citizenship to another country prior to being American citizens. This is exactly the problem Obama has. He held citizenship in another country (or two). This probably was obvious to most of you but my brain had to distill it down to one and two syllable words for me to REALLY get it. I knew he had a point, and I agreed with it and basically understood the case but NOW I REALLY get it. Ok – I am a little embarrassed to admit that it took this long for this point to sink in with me but MAYBE if you make the point the way that finally made it sink in for me, maybe some others with thick skulls will understand it that way too.

  299. j.b. Says:

Too bad Ed doen’t disconnect himself!
Just as I was able to forget he was even there…….whack!
His garbled, marbly, nicotine stained voice scares the sh!t outta me!

  300. Troy Says:

    Thinningmom,
Yes, the founding fathers had no choice but to put in a “grandfather clause” for themselves, but did’nt want that in the future

    sorry lone soldier,…..

plus it was one thing when they were attacking him…. but now that the SC staff is playing games with his friend Cort, it feels more personal

  302. ddlew Says:

I listened to Lamphere’s show (replay from Sunday Night I guess?) and he was explaining to a lady that Leo was the one that made the decision to never appear on Lan’s radio program again. And that although Lan offered to have his Blog hosted for free, Leo turned that offer down as well.

The way Lan explained it, he thought that he and Leo were cool but Leo pretty much dashed those thoughts.

  304. thinkingmom11 Says:

I got it that they had to grandfather themselves in but it just hit me that they were born on AMERICAN soil but because they had been citizens of another country they wouldn’t have been eligible to be president with the limitations they wanted to put on future presidents.

Here is Leo’s new youtube video he mentioned (er, someone did) earlier. Please watch it and pass it on. Oh and be prepared to be p!ssed off, again.

This is yet another example of how ALL the comments from so many are being blocked by the moderators ALL over the place!

    It’s a good one, though…….kinda long.

Hey, I have been listening to Cort.. I have a feeling that he may be lacking in funds to make the trip to take the files directly to the Supreme Court himself..Could someone perhaps start a fund to sent to him or to Leo for that purpose perhaps?? It would have to be done quickly.
